I own a domain name (.org, if that matters) which I intended to use for the purpose of posting family information, pictures, etc. At this time, there is no content.

I recently received an email from someone who has trademarked the name, which is also the domain name and was essentially told to not use it and I should contact back in order to get a transfer process underway.

This person is providing a non-profit service. I want to post family information. It is my understanding trademarks are essentially to prevent confusion amongst users. And I should be able to keep my domain name if I actually have a legitimate interest in the name and I did not purchase the domain in "bad faith."

I do not believe anyone will confuse my family's website with the non-profit service. The domain name is the surname of one side of my family, and I purchased the name with the intent of creating a website.

Can the owner of the trademark just take my domain name away or do I have a legitimate case for owning the domain name, so I can just sell it to the person?
