We had a few situations regarding trademarks. Most likely the owner of the registered trademark will win in the end, regardless of how quickly they pursue a potential trademark infringements.
If the trademark is current and maintained with the USPTO, it's bulletproof. I dought that verdict will hold up on appeal.
